The aim of this study was to explore the note-taking experiences of university students using paper-based and paperless resources. By means of a hermeneutic phenomenological approach, the note-taking experiences of 18 students from an international program at a university in Belgium were examined throughout a semester. In order to document these students’ practices with paper-based and paperless resources, four data collection methods were used: in-depth interviews observations focus group discussions and document analysis of students’ lecture notes. The results showed that (...) students experience note-taking as a complex phenomenon in which lived body, lived human relations, lived space and lived time come into play, and in which they try to find a balance between multiple engagements, between autonomy and authority, between attention and distraction, and between being original and mirroring others. This struggle for balance occurs irrespective of which medium they choose to use. These results provide an in-depth view of the phenomenon, and also highlight the complexity of the note-taking experience. (shrink)

La donación y el trasplante de órganos representan avances médicos cruciales, pero plantean importantes desafíos jurídicos y bioéticos. Este artículo examina la interacción entre el derecho y la bioética en la regulación de estas prácticas, abordando el problema de cómo garantizar un acceso justo y ético a los órganos, respetando la autonomía y dignidad humana. El objetivo es analizar los marcos legales y los principios bioéticos que subyacen a la donación y el trasplante, destacando su impacto en la práctica médica (...) y en la sociedad. Se utilizó una metodología basada en revisión bibliográfica, centrada en textos normativos, doctrinas bioéticas y casos relevantes. Los resultados evidencian la necesidad de fortalecer los marcos legales para equilibrar la equidad, el altruismo y la protección de los derechos individuales. Concluimos que un enfoque integral y multidisciplinario es esencial para abordar los desafíos actuales y futuros en esta área compleja y sensible. (shrink)

Background: Nurses encounter complex ethical dilemmas in everyday nursing care. It is important for nurses to have moral courage to act in these situations which threaten patients’ safety or their good care. However, there is lack of research of moral courage. Purpose: This study describes nurses’ experiences of care situations demanding moral courage and their actions in these situations. Method: A qualitative descriptive research design was applied. The data were collected with an open-ended question in the questionnaire used in validation (...) of the Nurses’ Moral Courage Scale. The sample consisted of 286 nurses from four different clinical fields in a major university hospital in Finland, providing a total of 611 answers. Data were analyzed using inductive content analysis. Ethical considerations: The study followed the commonly recognized principles of good scientific practice. The use of data was authorized by the developer of the instrument, the data collector, and the participating hospital. Ethical approval was obtained from the university ethics committee. Findings: Nurses acted morally courageously in most situations but sometimes they failed to do so. Although situations demanding moral courage varied, they could be categorized into seven main domains relating to colleagues, physicians, patients, relatives, nurses themselves, managers, and organizations. Nurses acted in the situations in different ways. The main acts in solving the situations were verbal communication or immediate action, such as interrupting of action. Conclusion: Care situations demanding moral courage focus on good and safe patient care and the patient’s good is at the center of attention. The situations are mostly related to the activities of other healthcare professionals. Findings may be applied in developing ethical nursing care through basic and continuing nursing education. Research is needed on the moral courage of physicians and managers, as well as on patients’ and their relatives’ experiences of care situations demanding moral courage. (shrink)

Science has always been tightly associated with environmental ethics in a way traditional ethics has not. However, despite this proximity, science has had a merely informational role, where it must inform ethics but not intervene in ethical judgment. Science is seen as an amoral enterprise, requiring an ethics rather than recommending one. In this paper I try to go against this common view. First, I give a critique of the naturalistic fallacy following the lines of Frankena. Then I go on (...) to describe the two possible roles science can have in ethical though, and in environmental ethics in particular. As it turns out, science does not only inform ethics, but can actually have moral import and intervene in moral judgment. Finally, from an ecocentric point of view, I try to illustrate this last point by construing the ecological notion of resilience as a moral boundary—a scientifically determined boundary between right and wrong. Machine unlearning (MU) is often analyzed in terms of how it can facilitate the “right to be forgotten.” In this commentary, we show that MU can support the OECD’s five principles for trustworthy AI, which are influencing AI development and regulation worldwide. This makes it a promising tool to translate AI principles into practice. We also argue that the implementation of MU is not without ethical risks. To address these concerns and amplify the positive impact of MU, we offer policy (...) recommendations across six categories to encourage the research and uptake of this potentially highly influential new technology. A democratic premise is that expert influence should not extend into the political domain of environmental policymaking. This article analyses the relationship between experts and policymakers in the historical development of the National Flood Insurance Program as a flood governance strategy in the United States. The article draws three conclusions. First, while experts asserted great influence on the development of this policy program, underlying values were evaluated and judged by policymakers. Second, as socio-political values changed, new types of experts were (...) involved in the policymaking process. As China and the United States strive to be the primary global leader in AI, their visions are coming into conflict. This is frequently painted as a fundamental clash of civilisations, with evidence based primarily around each country’s current political system and present geopolitical tensions. However, such a narrow view claims to extrapolate into the future from an analysis of a momentary situation, ignoring a wealth of historical factors that influence each country’s prevailing philosophy of technology and thus their overarching (...) AI strategies. In this article, we build a philosophy-of-technology-grounded framework to analyse what differences in Chinese and American AI policies exist and, on a fundamental level, why they exist. We support this with Natural Language Processing methods to provide an evidentiary basis for our analysis of policy differences. By looking at documents from three different American presidential administrations––Barack Obama, Donald Trump, and Joe Biden––as well as both national and local policy documents (many available only in Chinese) from China, we provide a thorough comparative analysis of policy differences. This article fills a gap in US–China AI policy comparison and constructs a framework for understanding the origin and trajectory of policy differences. By investigating what factors are informing each country’s philosophy of technology and thus their overall approach to AI policy, we argue that while significant obstacles to cooperation remain, there is room for dialogue and mutual growth. The aim of this work is to end the debate about the widespread acceptance among specialists, that the 6th century Byzantium treatise by Cassianus reached Muslim scholars by means of two routes: a translation from Greek into Arabic and the other translation by means of a Persian translation. Thanks to a comparison of the texts, one can prove beyond all doubt that there was only a secondary translation route into Arabic from the Persian version. Additionally, this work highlights the significant (...) influence of the Fila[hdotu]arumiyya on the Andalusian agronomy. The most influenced subjects are pointed out and those agronomic sources derived from this treatise and the 10th century Greek Geoponica are studied. This study allows us to conclude that the later work was never translated into Arabic, therefore, the Andalusian agronomists only had access to the Arabic versions of Anatolius and Cassianus to which the Pseudo-Qus[tdotu]us' work was later added. Resumen: En su libro Mujeres y discursos gerenciales. Hacia la autogestión feminista, María Medina-Vicent aborda desde una perspectiva crítica feminista los discursos gerenciales dirigidos a las mujeres, desvelando el androcentrismo y la presencia —y perpetuación— de tradicionales roles y estereotipos de género en los modelos de gestión. Mi propuesta pretende incidir en dos aspectos del análisis realizado por Medina-Vicent, por un lado, remarcar los peligros de la despolitización de los discursos gerenciales dirigidos a mujeres —sobre todo en tanto que la (...) literatura gerencial acaba por informarnos a todas—. Por otro, profundizar en la crítica que la autora realiza de la cooptación del feminismo por parte de estos discursos.: In her book Mujeres y discursos gerenciales. Hacia la autogestión feminista, Medina-Vicent approaches management discourses aimed at women from a critical feminist perspective, revealing the androcentrism and the presence and perpetuation of traditional gender roles and stereotypes in management models. My proposal aims to highlight two aspects of Medina-Vicent’s analysis: on the one hand, to highlight the dangers of depoliticizing management discourses aimed at women - especially insofar as management literature ends up informing us all. This paper analyses the information disclosures in two biobank consent documents used by biobanks operating under the General Data Protection Regulation (GDPR). The aim of the analysis is to investigate how these documents inform potential sample donors about possible future uses of biobank data. The findings suggest that the consent documents provide potentially misleading information regarding the range of possible future uses of biobank data. Based on these information disclosures, potential sample donors may reasonably believe that the data can only (...) be used for a narrowly defined range of research purposes. However, the range of lawful uses of the data is much broader and less clearly defined. Consent provided based on misleading information is not morally transformative, even if it were legally valid. To facilitate morally transformative biobank consent, this paper provides two recommendations for information disclosure to potential sample donors regarding future uses of biobank data: first, potential sample donors should be informed about the legal scope of consent; and second, they should be informed about the full range of lawful uses of biobank data. Una profesora de secundaria narra en tres momentos distintos los sucesos que han marcado su devenir como mujer, madre y enseñante durante la pandemia por COVID-19. En un recorrido que transcurre entre la sorpresa, la incertidumbre y el desencanto, emerge la reflexión de que la escuela ya no es ni será la misma, no solo por la diferencia entre la educación presencial y a distancia, sino porque las vidas de todos y todas se han transformado, porque muchos escolares han dejado (...) la escuela, más de cinco millones de niños, niñas y jóvenes. Afirma con contundencia ¡Este bicho tiene aporofobia! en alusión a la desigualdad social y la afectación a las personas en situación de pobreza. Reflexiona en torno a las distintas respuestas del profesorado y del sistema educativo, haciendo una fuerte crítica a la viabilidad y resultados del modelo “aprende en casa”. De ninguna manera es ajena a los efectos de la pandemia en los planos económico, laboral y educativo, pero se muestra renuente a dar credibilidad y adoptar soluciones que ubican la problemática solo en el plano de la voluntad y esfuerzo personal, sin reconocer que se trata de una crisis sistémica, que abarca a las instituciones sociales en conjunto. La expresión de emociones, vivencias y aprendizajes no esperados ante la ruptura de lo cotidiano, así como la experiencia del confinamiento por más de año y medio, permiten avizorar una nueva subjetividad en los actores de la educación, que deberá ser tomada en cuenta en el eventual regreso a los planteles escolares. La didáctica de las ciencias es cada vez más activa, por lo que una metodología ampliamente utilizada es el Aprendizaje Basado en Problemas (ABP). Este método implica la resolución de un problema, la que se recoge en un informe denominado Informe de resolución de problemas (IRP). Para los estudiantes esta tarea representa un gran desafío, ya que implica actuar y expresarse del modo en que lo harían los expertos en el área. Es debido a esta dificultad que se hace imprescindible (...) la orientación de los tutores a través de la retroalimentación. Existen distintos tipos y modos de retroalimentar, lo que generará un impacto en el desempeño de los estudiantes. Analizamos los comentarios evaluativos que entregan las especialistas a los estudiantes que elaboran un IRP, tanto en un borrador como en la versión final del escrito. A partir de la clasificación de comentarios escritos de Arancibia, Tapia-Ladino & Correa (2019), realizamos un análisis de los tipos y modos de comentarios evaluativos y cómo el objeto influencia el modo. Los resultados indican que, a la hora de retroalimentar, en el primer borrador las docentes centran su atención en la superficie más que en el contenido y el modo predominante es a través de órdenes. En la versión final, la retroalimentación se dirige más bien al contenido y las evaluaciones positivas y negativas aumentan. Se infiere que en la medida que los comentarios evaluativos promuevan la adecuación al género, los estudiantes se insertarán más fácilmente en la comunidad a la que han ingresado. (shrink)

News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

In recent years, policymakers, academics, and practitioners have increasingly called for the development of global governance mechanisms for artificial intelligence (AI). This paper considers the prospects for these calls in light of two other geopolitical trends: digital sovereignty and digital expansionism. While calls for global AI governance promote the surrender of some state sovereignty over AI, digital sovereignty and expansionism seek to secure greater state control over digital technologies. To demystify the tensions between these trends and their potential consequences, we (...) undertake a case analysis of digital sovereignty and digital expansionism in China, the European Union, and the United States. We argue that the extraterritoriality embedded in these three actors’ policies and escalatory competitive narratives, particularly those from the US, will likely undermine substantive global AI governance cooperation. However, nascent areas of alignment or compromise, notably in data governance and technical standards, could prove fruitful starting points for building trust in multilateral fora, such as the G20 or United Nations. This commentary examines the challenges faced by metaverse platforms in cross-border content moderation, focusing on the implications for freedom of expression and nondiscrimination. It highlights the difficulties in determining what to remove for which users as well as how to do so, which has serious implications for freedom of expression and our shared sense of reality. Proto-metaverse platforms such as Roblox and Minecraft face similar questions, but have not yet encountered major cross-jurisdictional issues because, as looking at traditional social media (...) platforms reveals, content moderation is not merely a question of law and policy, but also of geopolitics and government priorities. To avoid a “lowest common denominator effect” where freedom of expression is infringed upon worldwide and discrimination is entrenched, this commentary argues that metaverse platforms must clarify their moderation policies, assess their entry into specific markets based on local laws and their own values, and be prepared to exit overly restrictive markets. This paper analyzes ethnographic and historical data to emphasize the importance of framing health as collective wellbeing. Exploring missionary medical campaigns during the colonial period in East Africa, I connect the institutional legacy of Euro-American Protestant missions on the contemporary frameworks of US global public health provisions at my research site, Mwana Mwema Program. At this network of faith-based, USAID clinics in Kenya that provide treatment for children living with HIV, practitioners care for the wider community within a global health (...) system that bases donor funding on epidemiological criteria. This narrow framing conflicts with practitioners’ notions of healing as collective wellbeing and can exacerbate communal divisions. I argue that Mwana Mwema’s notion of collective wellbeing offers a healthcare framework that faith-based providers can embrace. It yields more holistic care for entire communities and offers an opportunity for those of us in the United States to rethink our notions of health. (shrink)

La Plataforma de Acción de Beijing en 1995, señala que la violencia contra las mujeres "es una manifestación de las relaciones de poder históricamente desiguales entre hombres y mujeres". En todos los ámbitos y etapas de la vida de las mujeres existen diversas formas en que la violencia de genero se expresa, pudiendo citar la violencia física, psicológica y sexual por parte de miembros de la familia o de su pareja, el abuso sexual por individuos que no son su pareja, (...) la prostitución forzada, la mutilación genital, el aborto selectivo, entre otras. Las consecuencias para la salud de las mujeres y sus familias urgen al sistema sanitario a tomar medidas para su identificación oportuna y respuestas adecuadas. Sin embargo, para que esto sea cierto se deben examinar las formas de reproducción de las desiguales relaciones de poder entre hombres y mujeres al interior del sistema y sus instituciones. (shrink)

En este trabajo sostenemos que el giro jonasiano experimentado por la teoría autopoiética de Varela, que tuvo como finalidad incluir un complemento teleológico para la autopoiesis, puede reemplazarse por la fenomenología de la biología del filósofo alemán Helmuth Plessner. Esta última, a diferencia de la propuesta jonasiana, no incluye presupuestos existenciales antropocentristas en la consideración de los seres vivos. Nuestro argumento se despliega en cuatro pasos: a) en primer lugar, desarrollaremos los elementos fundamentales de la versión clásica de la teoría (...) autopoiética, elaborada por Maturana y Varela en los años ’70, la que, entre otras cosas, es decididamente antiteleológica; b) luego, mostraremos que años más tarde, Varela se vuelca hacia la teleología en el llamado “giro jonasiano”, que incluye dentro de la teoría autopoiética elementos de la fenomenología existencial; c) posteriormente, desarrollaremos algunos de los elementos más relevantes de la fenomenología biológica plessneriana, especialmente los referidos al concepto de posicionalidad y que sirven para esta complementariedad entre la posición autopoiética y la plessneriana; d) para finalizar, concluiremos que la teoría autopoiética, debido a las acusaciones que recibe por haber girado hacia una filosofía existencialista, puede migrar hacia la fenomenología biológica plessneriana, la cual no adolece de los problemas antropocéntricos atribuidos a la fenomenología jonasiana. Primeiramente, oferecemos uma apresentação teórica da representação do pensamento prático, começando pela distinção entre silogismo dialético e silogismo demonstrativo. Fazemos referência à crítica de Toulmin contra o dedutivismo dominante de seu tempo. Em seguida, fornecemos argumentos para apoiar a relevância heurística do modelo de Toulmin para entender a discussão sobre a inclusão da lógica padrão na representação do pensamento comum. Afirmamos que o projeto analítico toulmaniano permite entender, com clareza metódica, a derrotabilidade dos argumentos do senso comum por meio da (...) investigação da noção modal de probabilidade na linguagem comum. First, we offer theoretical resemblance of the representation of practical reasoning, beginning with the distinction between demonstrative and dialectical syllogism. We make reference to the Toulmin’s critique against to the dominant deductivism in his time. Then we give arguments to sustain the heuristic relevance of Toulmin’s model to understand the discussion about the inclusion of default logics in the representation of ordinary reasoning. We assert that the Toulminian analytic design allows to understand, with methodical clarity, the defeasibility of common sense arguments by means of the investigation of the modal notion of probability in ordinary language. The SARS-CoV-2 (COVID-19) pandemic has caused social and economic devastation. As the milestone of two years of ‘living with the virus’ approaches, governments and businesses are attempting to develop means of reopening society whilst still protecting public health. However, developing interventions – particularly technological interventions – that find a safe, socially acceptable, and ethically justifiable balance between these two seemingly opposing demands is extremely challenging. There is no one right solution, but the current most popular ‘solution’ is the so-called ‘COVID-19 (...) Vaccine Passport’ (also known as COVID-19 passes or certificates), the use of which may be supported by both human rights and international public health law if they are designed and implemented appropriately. (We use the term ‘Vaccine Passport’ because it has been adopted by the popular press. Though it has been used in many ways, here we use it generically to refer to a document that certifies that an individual has been vaccinated against COVID-19 and on that basis grants the bearer more liberties than to those who have not been vaccinated. Later, we will discuss why it is necessary to move beyond considering only vaccinations, which informs our preferred term of ‘COVID-19 Status Pass’.) We set out to answer the following questions: how should governments and businesses assess the risks in light of human rights, public health ethics, and digital ethics concerns which emerge from developing and deploying COVID-19 Vaccine Passports? What design decisions should businesses make when developing COVID-19 Vaccine Passports to help ensure they respect human rights, and both public health and digital ethics? Do the implications for human rights, public health, and digital ethics vary depending on where and when COVID-19 Vaccine Passports are used? What are the rights and powers of the individual to object to or seek remedy for the use of COVID-19 Vaccine Passports? How can the risks of inequalities and social division derived from the deployment of COVID-19 Vaccine Passports be avoided or mitigated? We conducted a literature review and documentary analysis, supplementing our findings with news articles where appropriate. The following pages report our results, concluding with a series of actionable recommendations for businesses, national governments, and supranational organisations. (shrink)

Aunque esta terminología nos re­cuerda el arte de la guerra, el arte de vivir se asemeja más a la navegación.

Y, sin embargo, esta ubicua y recurrente alusión a los valores y a sus exigencias va acompañada a la vez de un clamoroso y tenaz silencio filosófico acerca de la naturaleza y el conocimiento de esos singulares objetos, al parecer tan importantes y omnipresentes. Las páginas que dan cuerpo a este libro han nacido de la necesidad de poner esas cosas de que tanto se habla en la tela de juicio de la filosofía.». (shrink)
